Supporting the Law 346 – 2004 and facilitating SMEs access to public procurement processes

Dear Minister,
The Chamber of Commerce and Industry of Romania, according to its statute conferred by the existing Romanian laws, from its position of representative of the business environment and advocate of the Romanian entrepreneurs’ interests, considers appropriate the development of the small and medium enterprises sector in Romania, an important pillar of the economy, with a great growth potential.
CCIR welcomes the governmental initiatives and supports maintaining the existing legislation which encourages small and medium enterprises’ access to instruments and programs which foster the development of the SME sector. Taking into consideration:
– the low share of SME in the total amount of public contracts at national level, an indicator which places Romania below the European average, according to the 2013 SBA Fact Sheet Romania;
– the statistics which denote low performances of the SME sector in Romania compared with partners in the European Union and
– the need to raise the share of the SME sector added value to the Romanian Gross Domestic Product,
The Chamber of Commerce and Industry of Romania considers appropriate to maintain the provisions of the Law no. 346/2004 regarding the stimulation of the creation and the development of small and medium enterprises¸ amended and supplemented, namely of article 16, paragraph 2, which stipulates granting a 50% reduction to SME regarding the criteria related to turnover, the participation guarantee and the performance bond guarantee, required for the public procurement of goods, works and services.
Through the enforcement of such a legislative measure, CCIR considers that the necessary framework is ensured to stimulate the SME participation within the governmental procurement programs, while offering the necessary tools to compensate SMEs’ lack of expertise and access to financial resources compared to the big enterprises in the Romanian economy.
CCIR considers that a measure of this kind encourages the access and participation of a large number of companies within the public procurement processes, thus contributing to more transparent and efficient procedures in the Romanian public institutions.
